These Terms and Conditions (“Terms”) govern your use of the Consultabid website and services, operated by ConsultaBid of Houston, Texas. By accessing or using our website, submitting a request, uploading a home inspection report, or otherwise using our services, you agree to be bound by these Terms. If you do not agree, you must not use our website or services.
1. Introduction
Consultabid provides data-driven home repair cost estimates based on information contained in home inspection reports and general market data. Our services are intended to help buyers, sellers, and real estate professionals better understand potential repair costs and negotiate more effectively during the home purchasing process.
2. Acceptance of Terms
By using this website or submitting any information through our platform, you confirm that you have read, understood, and agreed to these Terms, along with our Privacy Policy. If you are using the website on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.
3. Description of Service
Consultabid transforms home inspection reports into clear, practical repair cost estimates. These estimates are based on the information provided in the inspection report and general market data. Our reports are intended for informational, budgeting, and negotiation purposes only.
4. Eligibility
You must be at least 18 years old, or have legal authority to enter into a binding agreement, to use our services. By using Consultabid you represent that the information you provide is accurate to the best of your knowledge and that you are legally permitted to submit the documents or details you share with us.
5. Permitted Use
You agree to use our website and services only for lawful purposes. You must not use the website in any way that could damage, disable, overload, or interfere with the functioning of the site or with other users’ access. You may not attempt to access data, systems, or files that you are not authorized to access.
6. User Responsibilities
When you submit a home inspection report or other information, you are responsible for ensuring that the materials are complete, accurate, and legally shareable. You should not submit information you do not have the right to provide. You also agree not to submit unlawful, harmful, offensive, or misleading materials.
7. Estimates and Limitations
Consultabid is not a licensed contractor, engineer, or home inspector. Our estimates are approximate and are not guarantees of actual repair costs. They are not a substitute for professional contractor quotes, licensed engineering evaluations, or formal bids.
All repair estimates provided by Consultabid are generated from the information contained in the inspection report and general market data. Actual costs may vary due to labor rates, material availability, site conditions, hidden damage, contractor pricing, scope changes, and other factors beyond our control.
8. Delivery Times
We aim to deliver your estimate within 02 Hours of receiving a complete, readable inspection report, and in every case within 24 hours. Delivery times are estimates and may vary with workload, report complexity, or missing information.
A report is complete and readable if the document you upload is a home inspection report, its text can be read, and it contains enough detail to identify the deficiencies to be priced. If it is not, we will tell you promptly — see section 10.
9. No Professional Advice
The information provided by Consultabid is for informational purposes only. It does not constitute legal, financial, engineering, or construction advice. You should always consult appropriate licensed professionals before making major purchasing, repair, or contractual decisions.
10. Payment, Refunds and Cancellation
The price shown on our website is the price you will be charged. The current price is $89 per report, charged in full at the time of purchase.
Prices may change from time to time; the price in effect when you place your order is the price that applies to that order. Payment is handled by our payment provider, and we do not receive or store your full card details.
- Before we start — you may cancel at any time before we begin preparing your estimate, for a full refund. Email info@consultabid.com.
- Unreadable or incomplete reports — if what you upload is not a home inspection report, cannot be read, or does not contain enough information to price, we will tell you and refund you in full.
- After delivery — because the report is prepared specifically for you, it is not refundable once delivered, except as set out in section 8 or where we have made a material error. If you believe your estimate contains a material error, tell us within 14 days and we will review it and either correct it or refund the fee.
- How refunds are made — to the original payment method, normally within 5–10 business days.
11. Intellectual Property
All content on the Consultabid website, including text, graphics, branding, logos, report templates, layouts, and software, is owned by Consultabid or licensed to us and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from our content without prior written permission.
The estimate we prepare for you is yours to use in your own property transaction, including sharing it with your agent, lender, seller, or contractor. You may not resell it or republish it commercially.
12. Your Content and the Licence You Give Us
By submitting documents or content to Consultabid, you grant us a limited, non-exclusive licence to use, process, analyze and store that content solely to provide the service, maintain records, and meet our legal obligations. You retain ownership of your original materials. We do not use your inspection report or your estimate to train artificial-intelligence models, and we do not publish or share them except as described in our Privacy Policy.
13. Your Right to Upload the Report
An inspection report is usually prepared by a licensed inspector who holds copyright in it, and describes a property you may not own. By uploading a report you represent that you are entitled to share it with us for the purpose of obtaining an estimate, and you agree to indemnify us against any third-party claim arising from a document you upload that you were not entitled to share.
14. Privacy and Automated Processing
Your use of our website is also governed by our Privacy Policy, which explains how we collect, use, store, and protect your personal information. You acknowledge that the content of your inspection report is processed by automated systems, including a third-party artificial-intelligence service, as described in section 10 of that policy.
15. Third-Party Links
Our website may contain links to third-party websites or services. These links are provided for convenience only. We do not control and are not responsible for the content, policies, or practices of third-party sites. Accessing such websites is at your own risk.
16. Disclaimer of Warranties
Our website and services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Consultabid makes no warranties or representations, express or implied, about the accuracy, reliability, completeness, or availability of the website or services.
17. Limitation of Liability
Our total liability to you for any claim relating to the services will not exceed the greater of the amount you paid us in the twelve months before the claim arose, or $100. Nothing in these Terms limits any liability that cannot be limited by law, including under the Texas Deceptive Trade Practices–Consumer Protection Act.
To the fullest extent permitted by law, Consultabid shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of our website or services. This includes, without limitation, losses related to property purchases, repair decisions, negotiations, delayed transactions, or reliance on estimate results.
18. Indemnification
You agree to indemnify, defend, and hold harmless Consultabid, its owners, employees, contractors, and affiliates from any claims, damages, liabilities, costs, or expenses arising from your use of the website, your violation of these Terms, or your submission of inaccurate, unlawful, or unauthorized information.
19. Suspension or Termination
We reserve the right to suspend or terminate your access to our website or services at any time, with or without notice, if we believe you have violated these Terms, misused our services, or engaged in conduct that may harm Consultabid or other users. If we terminate your access while an order is outstanding and you are not at fault, we will refund that order.
20. Changes to Terms
We may update these Terms from time to time to reflect changes in our business, services, or legal requirements. The updated version will be posted on this page with a revised effective date. Changes do not apply retroactively to an order already placed. Continued use of the website after changes are posted means you accept the revised Terms.
21. Resolving a Problem
If something has gone wrong, contact us at info@consultabid.com and give us 30 days to put it right before starting any formal proceeding. Most problems are resolved this way, and it costs you nothing to try. Nothing in this section prevents either of us from bringing an individual claim in small claims court.
22. Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute not resolved under section 21 will be brought exclusively in the state or federal courts located in Harris County, Texas, and each party consents to the jurisdiction of those courts.
23. Severability
If any provision of these Terms is found to be unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
24. Entire Agreement, Waiver and Assignment
These Terms and the Privacy Policy are the entire agreement between you and Consultabid regarding the services. Our failure to enforce any provision is not a waiver of that provision. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
25. Survival
Sections 7, 11, 12, 13, 16, 17, 18, 22, 23 and 24 survive termination of these Terms.
26. Electronic Communications
You consent to receive communications from us electronically, and you agree that electronic agreements, notices, disclosures, and records satisfy any legal requirement that such communications be in writing.
